1. Acceptance of these terms
By using this website, logging into an account, or engaging BITT-TECH for services, you agree to these terms. If you are using our services on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.
2. Services and scope
BITT-TECH provides development services such as applications, websites, data warehousing, integrations, and related business systems. The specific deliverables, timelines, milestones, and acceptance criteria for each engagement are defined in the applicable written agreement. Anything not expressly included in that agreement is outside the original scope and may require a change request.
3. Accounts and access
Some areas of the site, including blog post creation, require an account. Admin and Writer access is reserved for authorized users. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly if you believe your account has been compromised.
4. Client responsibilities
Clients are responsible for providing accurate requirements, timely feedback, access to systems and content, and any approvals needed to keep a project moving. Delays caused by missing information, third-party vendor issues, or late approvals can affect timelines and delivery dates.
5. Fees, billing, and changes
Project fees, payment schedules, and retainer terms are governed by the signed proposal or invoice. Additional work, scope changes, and new requirements may require a written change order or revised estimate. Unless otherwise stated, invoices are due according to the payment terms on the invoice or agreement.
6. Intellectual property
Upon full payment, clients generally own the custom deliverables specifically created for them, subject to any pre-existing tools, frameworks, libraries, templates, or other materials that BITT-TECH owns or licenses. BITT-TECH retains ownership of its internal methods, reusable code patterns, know-how, and non-client-specific assets. Third-party components remain subject to their own licenses.
7. Confidentiality and data security
We treat client information as confidential and do not sell or distribute customer data. We use commercially reasonable safeguards such as encryption in transit, access controls, least-privilege access, and secure handling practices. For engagements that require specific encryption or additional controls, those requirements should be documented in the project scope. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Third-party services
Our solutions may rely on hosting, authentication, messaging, storage, or analytics tools provided by third parties. Those services are governed by their own availability, terms, and privacy practices. BITT-TECH is not responsible for outages, feature changes, or data handling performed outside the systems we directly control.
9. Acceptable use
You agree not to misuse the website or services, attempt unauthorized access, upload malicious code, interfere with the platform, or use the site for unlawful activity. We may suspend or terminate access if we believe these terms are being violated or if the platform is being used in a way that threatens security or service integrity.
10. Disclaimers
Except as expressly stated in a written project agreement, the website and services are provided on an "as is" and "as available" basis. We do not guarantee that the site will be uninterrupted, error-free, or that all deliverables will meet every possible use case without further iteration or maintenance.
11. Limitation of liability
To the maximum extent permitted by law, BITT-TECH will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or business opportunity arising from use of the website or services. Where liability cannot be excluded, it will be limited to the amount paid for the affected services during the period specified by the applicable agreement or, if none is specified, to the minimum extent allowed by law.
12. Termination and changes
We may update these terms from time to time. Continued use of the website or services after an update means you accept the revised terms. We may also suspend or terminate access for misuse, nonpayment, security issues, or other material breach of these terms or the applicable project agreement.
